My matter touches several of these areas. Is that a problem?
No — most substantial matters do. A business sale can involve corporate, property, employment and IP at once. One lawyer takes carriage and pulls in the others as needed, so you are not managing four relationships.
Do you act for both sides of a transaction — landlords and tenants, buyers and sellers?
We act for both, but never on the same transaction. Every new matter goes through a conflict check before we can accept instructions.
What is a conflict check, and why do you need details before I can talk to a lawyer?
Before acting we must confirm we do not already act for someone on the other side, and that we hold no confidential information that would prevent us from acting. That requires the names of the parties. It is also why you should not send confidential material until we have confirmed we are able to act.
Can you take over a matter another firm has been running?
Yes. A transfer part-way through is common, particularly where a matter has changed character. We obtain the file from the previous firm, review where things stand, and give you a view on the position and the cost of continuing before you commit.
Do you offer fixed fees?
For work that can be scoped — a lease, a business sale, a will, a shareholders agreement, a development approval application — yes. Disputes are harder to fix in advance because the other side controls half the variables, so we work to stage estimates and tell you when the position moves.
I am not sure which area my problem falls into. What should I do?
Describe what has happened rather than trying to classify it. Send an enquiry or call the firm, and we will work out which team it belongs to — that is our job, not yours.
